Group Terms
Introduction
Welcome! You are about to create a Pictalk Group ("Group"), please take a moment to read this agreement as it describes your roles and responsibilities when you create and administrate a Pictalk Group. Before creating a Pictalk Group, you must agree to abide by our Terms of Use and our Privacy Policy. Additionally, when creating a Pictalk Group you must agree to everything within this disclosure statement.
Creating a Pictalk Group
The purpose of creating a Pictalk Group is to allow Pictalk users to meet and communicate with other users that share similar interests. As the creator of the Pictalk Group, you will be deemed the "Owner". As the Owner of a Pictalk Group you will have unique privileges and responsibilities.
An Owner may create a Public Group, a Closed Group, or a Private Group via the Pictalk platform. While creating a Pictalk Public Group or a Pictalk Closed Group, the Owner shall have the option to choose whether any content in the group can be reposted, stashed or shared. Content in a Private Group cannot be reposted, stashed or shared.
Public Groups
Pictalk Public Groups may be joined by all Pictalk users. Users wishing to join a Public Group must simply press the "Join Group" button on the desired Pictalk Group Page. Please be aware that any content posted on a Public Group is accessible and may be viewed by all Pictalk users. Additionally, all content posted within a Public Group may be reposted on the Pictalk Platform by any Public Group member depending on the Public Group content settings.
Closed Groups
All Pictalk users may request to join a Pictalk Closed Group. The Pictalk user's request to join must be approved by either the Closed Group's Owner or Administrators, at their sole discretion. Please be aware that any content posted on a Closed Group is accessible and may be viewed by all Pictalk users depending on the Closed Group content settings. Additionally, all content posted within a Closed Group may be reposted by another Pictalk user who is a member of that specific Closed Group.
Private Groups
Pictalk Private Groups may only be joined by Pictalk users who have been invited to that specific Private Group. The Private Group's Owner or Administrators must invite users of the Pictalk community to become a member. Once a Pictalk user has joined a Private Group, they will be able to view photos and content posted by all members of that specific Private Group. The content found within a Private Group may only be viewed by group members.
Inviting Users to the Pictalk Group
The Owner of a Public, Closed or Private Group may invite, approve, or remove members using the Group control settings. The Owner may also use the Owner settings to allow other group members (Administrators) to invite users into the Pictalk Group. Members who accept an invite from a Pictalk Group shall be automatically added once they accept an invite. Members wishing to join a Closed Group shall have a "Pending" status until the Owner or other approved group member (Administrator) has approved such prospective member. Once a member has been approved a "Member" status shall be displayed within the Member's profile.
Owner Privileges
The Owner has control over all the content posted within the Pictalk Group. The Owner may allow content to be reposted, shared or stashed (Private Groups excepted) and controls membership in the group. The Owner may delete any content posted within a Pictalk Group and may also use the Owner settings to allow other group members (Administrators) to delete any content posted within a Pictalk Group. The Owner may remove any member of the group and may also use the Owner's settings to allow other group members (Administrators) to remove any member of the group.
Appointing Administrators and Transferring Ownership
The Owner may also appoint and remove administrators ("Administrator(s)") and may transfer control of a Pictalk Group to another member of the group.
In order to appoint an Administrator, the Owner will have to use the control panel and appoint another member of this group as an Administrator. That member will be sent a request via the Pictalk Notification System and must accept the Administrator invite. Administrators may have the ability to delete content in the group and approve membership in the Pictalk Group, depending on the group settings. Administrators may also remove members in a Pictalk Group.
In order to transfer control, the Owner will have to initiate a Transfer Ownership Request through the Owner control panel. The prospective member will be alerted to the Transfer Ownership Request via the Pictalk Notification System. Once the Transfer Ownership Request has been approved by the member, control of the Pictalk Group will be transferred to that respective member. Once a transfer has occurred, the Owner will not be able to revoke the transfer and will lose all administrative privileges related to the Pictalk Group.
Using and Sharing Content within a Pictalk Group
Once you have created a Pictalk Group you will be allowed to share, stash, and repost content with the group. Please remember that Pictalk is a community of users and thus you should always act responsibly and respectfully when communicating or sharing content on Pictalk or within a group. Please be aware that Pictalk may remove any content that is deemed lewd, illegal, defamatory, distasteful or at our sole discretion to ensure that all users have a great experience on Pictalk. Depending on the group settings all members of the Pictalk community may be able to view any content posted.
Deleting a Group
An owner may delete a Pictalk Group once all content has been deleted from within the Group. All data and content must be removed prior to any deletion. Upon deletion of a Group, all members within the Group shall receive a notification that the Group has been deleted by the Owner.
Frozen Group
A Frozen Group occurs when either (i) the Owner of the group deletes their Pictalk account; or (ii) if the Owner's Pictalk account is suspended. Once a Group is frozen, no additional content may be posted by any members of the group and all content sharing permissions will also be frozen. In order to unfreeze a Group, a member of the Group shall have to appeal to Pictalk for any ownership change.
Memorialized Groups
A Group will be considered memorialized when Pictalk receives proof of death of the Group's owner. In order to unfreeze a memorialized Group, a member of the Group shall have to appeal to Pictalk for any ownership change.
Change of Ownership
Where a group has been frozen or where the Owner of the group no longer has an active Pictalk account, members of the Group may appeal to Pictalk for a change in Group ownership. All Pictalk ownership transfers are made at the sole discretion of Pictalk. Some factors Pictalk may consider when transferring ownership include: (i) member status; (ii) member seniority; and (iii) member activity. Pictalk reserves the right to deny all change of ownership requests.
Pictalk Group Administrator Statement
Introduction
Welcome! You have received a request to become an Administrator of a Pictalk Group, please take a moment to read this agreement as it describes your roles and responsibilities as an Administrator of the Pictalk Group. You must agree with this statement before you may become an Administrator.
Acceptance
In order to become and Administrator, you must accept the request received via the Pictalk Notification System. Once you have accepted the request to be a Pictalk Group Administrator you will be granted additional privileges as designated by the Pictalk Group Owner.
Roles and Responsibilities
As an Administrator, you will have the ability to delete content in your Pictalk group, remove group members and any additional privileges granted by the Owner of the Pictalk Group. If you have any questions, please contact the Owner of your particular Pictalk Group.
Pictalk Group Transfer Statement
Introduction
Welcome! You have received a request to become the new owner of a Pictalk Group ("Owner"). Please take a moment to read this agreement as it describes your roles and responsibilities as the new Owner of the Pictalk Group. You must agree with this statement before you may accept ownership of the Pictalk Group.
Transfer of the Pictalk Group
You have received a request from the current Owner of the Pictalk Group with which you are currently a member. You must accept ownership of the Pictalk Group via the Pictalk Notification System to become the new Owner of the group. Please be aware that accepting ownership of a Pictalk Group carries with it additional roles and responsibilities.
Pictalk Group Ownership Responsibilities
As the new Owner of the Pictalk Group you shall have the following responsibilities:
Control a Pictalk Group
The Owner shall have control over content within the Pictalk Group. For Public or Closed Groups, the Owner may select whether the content can be reposted, stashed or shared. The Owner may delete any content, comment or reply posted within the Pictalk Group page. However, the Owner shall be unable to edit any of the actual content posted by other group members. The Owner shall also be able to add Administrator(s) and remove any members of the group as necessary. We allow you to have these privileges to ensure that all group members have an enjoyable experience while using Pictalk.
Public Groups
Pictalk Public Groups may be joined by all Pictalk users. Users wishing to join a Public Group must simply press the "Join Group" button on the desired Pictalk Group Page. Please be aware that any content posted on a Public Group is accessible and may be viewed by all Pictalk users. Additionally, all content posted within a Public Group may be reposted by another Pictalk user who is a group member of that specific Public Group.
Closed Groups
All Pictalk users may request to join a Pictalk Closed Group. The Pictalk user's request to join must be approved by either the Closed Group's Owner or Administrators, at their sole discretion. Please be aware that any content posted on a Closed Group is accessible and may be viewed by all Pictalk users. Additionally, all content posted within a Closed Group may be reposted by another Pictalk user who is a member of that specific Closed Group.
Private Groups
Pictalk Private Groups may only be joined by Pictalk users who have been invited to that specific Private Group. The Private Group's Owner or Administrators must invite users of the Pictalk community to become a member. When using Pictalk and joining a Pictalk Group, you must agree to and abide by our Terms of Service and our Privacy Policy. Additionally, when joining a Pictalk Group you must agree to this disclosure.
Joining a Pictalk Group
The purpose of joining a Pictalk Group is to meet other Pictalk users who share similar interests with you. Pictalk Groups allow you to communicate with other users and share content as images, photos and videos. Please be aware that depending on the Pictalk Group's settings, the content may be viewed and shared by others within the Pictalk community.
Pictalk Groups are divided into three groups; Public, Closed and Private:
Public Groups
Pictalk Public Groups may be joined by all Pictalk users. Users wishing to join a Public Group must simply press the "Join Group" button on the desired Pictalk Group Page. Please be aware that any content posted on a Public Group is accessible and may be viewed by all Pictalk users. Additionally, all content posted within a Public Group may be reposted by another Pictalk user who is a group member of that specific Public Group.
Closed Groups
All Pictalk users may request to join a Pictalk Closed Group. The Pictalk user's request to join must be approved by either the Closed Group's Owner or Administrators, at their sole discretion. Once a Pictalk user has joined a Private Group, they will be able to view photos and content posted by all members of that specific Private Group. The content found within a Private Group may only be viewed by group members.
Using and Sharing Content within a Pictalk Group
Once you have created a Pictalk Group you will be allowed to share content with the group. Please remember that Pictalk is a community of users and thus you should always act responsibly and respectfully when communication or sharing content on Pictalk or within a group. Please be aware that Pictalk may remove any content that is deemed lewd, illegal, defamatory, distasteful or at our sole discretion to ensure that all users have a great experience on Pictalk.
License Ownership and Grant
At Pictalk we respect your intellectual property rights. Therefore, you retain the rights to any content posted on Pictalk. However, all content is subject to the licensing provisions as stated within the Pictalk Terms of Service.
